DEFINITIONS
​​The “Contractor” is defined as the legal entity Platinum Cake Designs, LLC. The “Client” means the person (legal or natural) who buys the product. “Product” is defined as the item(s) to be supplied by the Contractor to the Client as listed on the invoice. The “Site” is defined as this website. The “Terms” refers to the Terms and Conditions as outlined in this document.
GENERAL
These Terms shall apply to the sale of the Product by the Contractor to the Client to the exclusion of all other terms and conditions referred except where the Contractor has agreed to such variation in writing and by way of signature. By ordering from the Contractor you agree to be legally bound by these Terms and accept that these Terms may be modified or amended and posted on this website from time to time. The Terms are also attached to all invoices. By making a payment the Client is accepting the Terms and Conditions as detailed on the site.
TERMS
Payment And Retainer

For orders with a Total Balance over $240, we require a 50% NON-REFUNDABLE Dessert Retainer Fee to confirm a product order and reserve the date and delivery window. The Remaining Balance is due 21 days before the delivery date, at which point all changes must be confirmed (changes to the previously agreed design may incur extra fees).

Orders must be paid in full if the order is placed less than 21 days in advance of the delivery date or if the order has a Total Balance less than $240.

The balance specified on the invoice must be paid by the Client by the date(s) specified on the invoice. If the amount due is not paid by the invoice due date, the Contractor reserves the right to cancel the invoice and notify the Client via email. If the Client decides to move forward with the order, a $25 administration fee will be added to the new invoice for creating another invoice.
​​​​​Cancellations and Date/Time Changes

If the Client needs to cancel the Event Date, the Client is responsible for notifying the Contractor of the date change as early as possible via email. Cancellations can be made up to 14 days prior to the delivery date for a refund of the Total Amount Paid minus the Dessert Retainer and any items purchased or made specifically for the Client’s order. The Dessert Retainer is not refundable for any reason. No refunds will be issued for orders canceled within 7 days of the delivery date. There will be NO REFUNDS available after product delivery, only credit towards future order(s). Credits are non-transferable and non-refundable.​

If the Client needs to change/postpone the Event Date, the Client is responsible for notifying the Contractor of the date change or postponement as early as possible via email. If the Contractor is unable to accommodate the date change or the postponement or date change is made 14 days prior to the delivery date, then the Client will receive a credit of the Total Amount Paid. The Contractor will try to accommodate the date change. However, the Contractor is not obligated to accept the date change if they are booked for the new date or unavailable. If the Client postponed the event or the changed the event date 7 days prior to the delivery date, then the Client will be issued a credit for any monies already paid toward the Total Amount Due minus the Dessert Retainer and any items purchased or made specifically for the Client’s order. The credit will be valid for 1 year from the original Event Date, the Credit Expiry Date, and the credit will be forfeited to the Contractor after the Credit Expiry Date. Credits are non-transferable and non-refundable. The Client is still responsible for the total set in the original contract.

In the very unlikely event that the Contractor has to cancel the Client’s order for any reason, then the Contractor will give the Client as much notice as possible and discuss the matter with Client and try to agree on a suitable alternative. If the Client does not accept our suggested alternative, then the Contractor will refund the full price to the Client.
Refund Policy

All sales are final. In the case of an emergency or an error in the dessert delivery, please contact the Contractor immediately so the Contractor can remedy the issue right away. If the Client is not satisfied with their dessert for any reason, please call the Contractor on the day of the event and explain the situation. In the rare case that the Client is unsatisfied with the dessert, the uneaten dessert must be returned to the Contractor to be evaluated based on the complaint. Without proof of the problem, the Contractor will be unable to issue any credit to the Client.

DO NOT smash cakes or other desserts into anyone's face due to the stiffness of the buttercream and support structure within the dessert. The Contractor is NOT responsible for bodily damages caused by such acts.

Clients requesting a refund after orders are delivered must return all uneaten portions of the product purchased for evaluation. Flavor and texture are subjective. If the Contractor determines the order does not meet their standard, then the Contractor will issue a credit towards future purchases to be used within 1 year of the Event Date or a refund.

Design and style are subjective. If the Client is dissatisfied with the dessert design, the Client should contact the Contractor immediately. If the Contractor determines that the dessert is not in keeping with their design aesthetic, is not similar to the sketch delivered, and/or does fit the scope of the theme, then the Contractor will issue a credit towards future purchases to be used within 1 year of the Event Date.

There will be no refund of monies paid or credit for the request to "downsize" the order once the Remaining Balance is paid.

If there is a request to increase the order and the Contractor is able to accommodate this change, payment of the difference is due immediately or the request will not be honored.
​​​​​​Risk or Loss

In the event of a "natural disaster", “Act of God”, or an emergency preventing the Client from receiving the order by delivery or pick-up, the Contractor will follow the process outlined in Section B4. No refunds will be issued. The Contractor will not require a new Dessert Retainer or assess any penalty fees.
- In the event of a nation-wide or "state of emergency," issued by the federal, state or local municipalities that results in the event being canceled or postponed, the Contractor will follow the process outlined in Section B6. No refunds will be issued. The Contractor will not require a new Dessert Retainer or assess any penalty fees.

In the event of the death of the Client, all monies in excess of the Dessert Retainer will be refunded to the Client within 7 business days. In case of death of the Contractor, all monies will be refunded within 7 days of their death by the authorized representative.

In the event that the Client becomes sick within 3 days of the Event Date, please notify the Contractor IMMEDIATELY to reschedule the event. The Contractor will follow the process outlined in Section B6. No refunds will be issued. The Contractor will not require a new Dessert Retainer or assess any penalty fees.
​​Delivery Details and Display

Delivery is suggested for all desserts. The Contractor strongly recommends delivery for all tiered and sculpted cakes to ensure safe delivery of those cakes. Clients who pickup their desserts should have adequate space and a level surface for safe transport.

The Client should ensure that the designated dessert area is ready for set-up during the Delivery Window. The Contractor will arrange stands for the desserts.

The Contractor will deliver dessert(s) to the Delivery Address within the 1-hour Delivery Window. Delivery does NOT include setup, styling, carry out containers, cake cutting utensils, cake cutting services or serving services. The Contractor will provide a serving guide and a list of inedible items that should be removed prior to serving. Cake cutting services can be provided for an additional cost of $50/hr starting from the end of the Delivery Window to the end of the cake serving for a minimum of 4 hours and is based on Contractor availability.

To ensure the quality of the dessert, cakes, cakesicles, and cupcakes should be kept at a temperature of 76°F or cooler to avoid melting fondant, chocolate, and/or buttercream. Desserts should NOT be displayed in direct sunlight. Desserts should be displayed on sturdy, level cake plates and/or tables.

Repair of cake damages required due to no fault of the Contractor or delivery representative after setup is complete and after the Contractor or delivery representative have departed, will incur a $100 service fee to be paid prior to us fixing any issues and is subject to availability. We will be unable to return to venues greater than 20 miles to repair damages. Although the cake will be structurally sound, the Client or their designated party will be responsible for the security of the cake once the cake has been delivered.

If the Client has an event outside, cake should neither be in direct sunlight nor outside longer than 30 minutes for temperatures exceeding 76°F, the Contractor is not responsible for damages such as melting, bug infestation, or other damages associated with warm weather that could occur and prevent safe consumption of the dessert. The Contractor recommends ordering a faux cake for outside display and kitchen cakes for serving. The Contractor recommends all other desserts be displayed and served inside or brought outside only for serving.

The Contractor agrees to deliver the dessert in a timely, professional manner. In the event the Contractor does not meet the Delivery Window due to circumstances beyond their control, the Contractor will contact the Day of Contact immediately and waive the Delivery Fee. This also includes you or your representative having to pick up your order.
​​Designs Details and Photography

Client design and/or Flavor changes can be made up to 21 days before the delivery date. The Contractor will assess Client change requests and determine if they can accommodate the request and if there is a change in price. Client change requests made less than 21 days before the delivery date are not guaranteed. The Contractor reserves the right to make minor changes to the design to ensure the structural integrity of the dessert. However, the essence of the sketch will be captured in the final design of the dessert.

The Contractor will use photos, color swatches, invitations, etc, provided by the Client as inspiration for the dessert design. However, the Contractor will not copy another artist’s work or use copyrighted material. Sample items will not be returned to the client unless specifically requested and a self-addressed, postage-paid packaging is provided to the Contractor.

The Contractor will attempt to match the color scheme as closely as possible, but there may be a slight color variance due to the nature of food.

The Contractor understands that the health and safety of their Client is paramount, so under no circumstances will DISCO DUST, LUSTER DUST, OR GLITTER be used by the Contractor on food items to be consumed unless it is labeled EDIBLE or FDA approved. These items are otherwise NONTOXIC but are not meant for human consumption. They may only be used on decorations that are to be removed prior to consumption. Sanding sugar, edible pearls, and ONLY hybrid or sparkle dust that are labeled EDIBLE can be used.

The Contractor will photograph the dessert(s) prior to delivery and onsite and/or order copies of pictures from the Client’s photographer. The Contractor reserves the right to use any photographs for its own reference or for display and/or promotion without compensation to the Client.

The Contractor retains the rights to share photographs of orders for advertising purposes and networking purposes. Photos will not be posted until AFTER the order has been picked up or delivered. If the Client does not wish to be tagged or have their name mentioned in social media, please notify us via email prior to pick-up or delivery.

The Contractor does not provide a preview of a Client order as it delays the work process.
Allergen and Safety Policy

Desserts may contain or come into contact with milk, eggs, wheat, nuts, soy, cocoa, or other allergens. The Contractor is not responsible for any allergic reactions or medical conditions resulting from our desserts. It is the sole responsibility of the Client to advise the Contractor of any allergies. It is the sole responsibility of the Client to inform their guests of any allergens. The Contractor is not responsible physically or financially for medical issues or emergencies including death that may occur.

The Contractor is a gluten-friendly bakery, but the Contractor cannot guarantee the Client’s dessert will not come in contact with allergens. Therefore, the Contractor does not offer gluten-free desserts to Clients with celiac disease. The Contractor does not make vegan or vegetarian desserts.

If the Client chooses to use fresh flowers on the cake from a florist, the Client is responsible for selecting the florist and the safety of the flowers used. Not all fresh flowers are food products and should not be treated as such. Fresh flowers will not be provided by the Contractor. By initialing, the Client waives the rights to compensation if illness or other death occur from floral products. The Contractor will do their best to protect the florals from direct contact with the cake itself.
Payment Methods
​Payment is accepted in the form of ACH, major credit cards, and Cash App through Square Invoicing. The Contractor does not accept personal checks, Venmo, or Zelle. All invoices are sent via email through Square. The Contractor does not receive the Client’s payment information, nor does the Contractor share the information with outside vendors or 3rd party sources. The Contractor does not sell the Client’s information.
​Our Guarantee The Contractor wants to deliver a dessert that meets or exceeds the Client’s expectations. The Contractor will work with the Client to ensure the Client is satisfied with the dessert. The Terms is meant to ensure that the Client's event is made special by safely delivering a beautiful, uniquely-designed, and delicious dessert.
